Powers of Attorney

Overview

There are two general powers of attorney that are a must-have for anybody planning their estate. One type is to provide an incapacitated individual with the ability to transact business through an “agent” (e.g. sign checks, sign documents, access accounts, etc.), commonly referred to as a durable power of attorney or general power of attorney. The other power of attorney is also known as a medical directive and appoints an agent on behalf of an individual who is not in the position to make critical decisions regarding healthcare and end of life decisions.

General Durable Power of Attorney for Financial Affairs – A document established by an individual (the principal) granting another person (the agent) the right and authority to handle the financial affairs for the principal. A durable power of attorney remains in effect even after the principal becomes incompetent.

Durable Medical Power of Attorney or Advanced Directive – A document established by an individual (the principal) granting another person (the agent) the right and authority to handle matters related to the health care of the principal. An advance care directive is a document that specifies the medical care a person wishes to receive in case that they are unable to communicate their wishes
